Study: Death Penalty Will Cost California Up To $7.7 Billion By 2050

California’s prison system is severelyovercrowded and expensive, but incarceration for those sentenced to life without parole is not the state’s most costly form of punishment. With a state initiative to eliminate capital punishment on the ballot this November, an updated study by a law professor and a federal appeals court judge projects that California’s death penalty system would cost taxpayers between $5.4 and $7.7 billion more between now and 2050 than if those in death row were sentenced to life in prison without parole.

During that time, the study projects, about 740 more inmates will be added to death row and 14 executions will be carried out, while more than 500 of those prisoners will die from suicide or natural causes before the state executes them. Compared to life without parole — the state’s second-most-severe punishment — the costs of the death penalty system include higher incarceration costs due to security and other requirements, and astronomical litigation costs — both for individual appeals and for lethal injection litigation.

Ninth Circuit Senior Judge Arthur L. Alarcón and Loyola Law School Los Angeles adjunct professor Paula M. Mitchell explain in the Loyola of Los Angeles Law Review:

[T]here is absolutely no support for the contention, advanced by some pro-death-penalty organizations, that replacing the death penalty with LWOP [life without parole] will increase housing or medical care costs for the state. Death-row inmates grow old and need costly medical care, just as LWOP inmates do. Indeed, death row inmates receive the same medical care that LWOP inmates receive, but it is provided at a premium due to logistical problems and security concerns that are endemic to providing healthcare to aging inmates on San Quentin’s death row. The vast majority of death-row prisoners who have died in California have lived out the remainder of their natural lives in state prison, just as LWOP inmates do. This is because most death-row inmates die in prison of natural causes. They just do so in a much more costly manner than do LWOP inmates.

If the state were to pass the proposed SAFE California Act (Proposition 34), $30 million per year would be reallocated toward the 46 percent of homicide cases and 56 percent of rape cases that go unsolved, according to statistics from the California Attorney General’s office.

Since 1989, California has sentenced two men to death who were later exonerated and released from prison. In 2011 and 2012 alone, five California men who were wrongfully convicted of murder but received lesser sentences were exonerated and released from prison, according to the study.

The National Registry of Exonerations — a database of those who were wrongfully convicted and later exonerated since 1989 — reports that California had the second-highest number of wrongful convictions in the country at 97 (tied with Texas). The state with the highest number, Illinois, eliminated the death penalty in 2011.

Lawyers for condemned Philadelphia killer Terrance “Terry” Williams Tuesday afternoon asked the state Board of Pardons to reconsider Williams’ petition for clemency, citing purportedly inaccurate information a prosecutor provided the board at the hearing on Monday.

Though the board voted 3 to 2 for clemency for Williams, 46, who is scheduled for execution on Oct. 3, a unanimous vote was needed for the nonbinding recommendation to be sent to Gov. Corbett.

In a letter to the board, Williams’ lawyers asked for reconsideration because of the way Assistant District Attorney Thomas Dolgenos answered a question from pardons board member Harris Gubernick.

HARRISBURG — The state Board of Pardons on Monday rejected a bid for clemency from a convicted murderer who is scheduled to become the first person executed by Pennsylvania since 1999.

The case of Terrance Williams has mobilized supporters, who say a history of sexual abuse by several men — including the man whose murder resulted in the death sentence — is reason to stop the execution scheduled for Oct. 3. Separately, a Philadelphia judge has agreed to hear evidence on Thursday about the claims of sexual abuse.

Pennsylvania has not executed someone who contested a death sentence since 1962. After two hours of testimony Monday, three of the five members of the Board of Pardons, including Attorney General Linda Kelly, voted to recommend that Gov. Tom Corbett grant clemency. But a unanimous decision is needed in cases with a sentence of death or life imprisonment, so the two opposing votes, including that of Lt. Gov. Jim Cawley, meant the application was denied.

Williams, now 46, was convicted in 1986 of first-degree murder, robbery and conspiracy in the death of Amos Norwood in Philadelphia. At the hearing on Monday, Shawn Nolan, a federal public defender, said clemency is warranted because Williams had been sexually abused from a young age by several men, including for years by Norwood. Williams also was beaten by his mother and stepfather, Mr. Nolan said.

“Who is Terry Williams?” he said. “He is a man shaped by the horror of his childhood.”

Williams is now is remorseful for his crimes, Mr. Nolan said.

Mr. Nolan also asked the board to heed a statement by Norwood’s widow that she did not want Williams put to death. And he cited statements by several jurors saying they would not have chosen the death penalty had they known of the claims of sexual abuse. Some also said they chose the death penalty because they thought a person sentenced to life could be paroled.

Tom Dolgenos, chief of the federal litigation unit at the Philadelphia district attorney’s office, countered that the Norwood murder was the culmination of an escalating series of crimes by Williams. He said the board should consider that decades of litigation had failed to reverse the sentence. And he asserted that Williams has a record of lying to escape consequences, while also noting that claims of abuse were not raised until years after trial. That delay, he said, was reason to be skeptical.

“The only way to grant clemency here is to accept the truth of these allegations,” he said.

David Lisak, a clinical psychologist who spoke in support of clemency, told the board that it is typical for victims, especially men, to recount past sexual abuse in a piecemeal fashion over a period of time. Several supporters of clemency urged board members to consider the promises made to victims when former Penn State assistant football coach Jerry Sandusky was charged and then convicted of child sexual abuse.

“Is it only some kids who get to be believed?” Mr. Lisak said.

But Mr. Dolgenos asserted that those cases were different, in part because Williams has something to gain by making claims of abuse.

“He has every incentive now to allege them — and to make them up if they didn’t actually happen,” Mr. Dolgenos said.

Proponents of clemency for Williams point to support from former judges and prosecutors as well as child advocates and others to argue the case is unique. An online petition seeking to stop the execution has more than 350,000 signatures, and the state’s Catholic bishops had written in support of commuting the sentence to life in prison.

At the hearing Thursday in Philadelphia, attorneys for Williams will request a stay of execution based on the allegations of sexual abuse. Mr. Nolan said they will argue prosecutors had evidence of sexual abuse that they did not disclose to the defense. The judge’s decision in the request can be appealed to the state Supreme Court.

Two hundred people are on death row in Pennsylvania.

Terrance Williams of Pennsylvania has been sentenced to death after killing two men when he was 17- and 18-years old. What the jury did not know, however, was that Williams had been brutally raped as a child by the two men he killed.  

Williams and another teen killed one man just a few months after Williams had turned 18, according to Change.org. He also admitted that he killed another man five months earlier. One man was a church leader and another was a sports booster. The men used their positions to get access to young boys.

Williams was allegedly sexually abused for years by these men, but he was also abused by other older individuals throughout his life. His mother had abused him frequently and his father was absent from the home. His first experience with sexual assault was when he was just six years old, and the abuse continued steadily for the next 12 years of his life.  

He did not receive treatment or help from anyone for the duration of his suffering. 

How do we know these abuse accusations are true — and not just Williams making a calculated attempt at saving his life?

According to The Nation, “It was not until this past winter that another witness would come forward, a former pastor named Charles Pointdexter, who knew Norwood for thirty years. He admitted having known that he had sexually abused teen boys.

“Amos seemed to have lots of close relationships with young men…” he stated in an affidavit signed February 9, 2012, saying that he began to suspect that they were “inappropriate” in nature. A few years before Amos’s death, one of the parishioners, the mother of a 15-year-old boy, told him that he had “touched her son’s genitals” during a car ride and that “Amos had inappropriately touched a number of boys at the church.” Pointdexter kept the knowledge to himself.

Because Williams was embarrassed and ashamed by the abuse, he says he did not present his experiences as evidence for trial. His lawyer also failed to conduct a thorough investigation of Williams’ motivations for killing the men, and ignored obvious signs of sexual abuse.

Many notable people have come forward to state that they would like his sentence to be reduced to life without parole. Among those objecting to his sentencing include the wife of one victim, five jurors from the trial, judges, child advocates, former prosecutors, faith leaders, mental health professionals, and law professors.

Jurors from the trial now say they would not have voted for execution had they known about his experiences with sexual abuse as a child.

A widow of one victim said that she has forgiven Williams and does not want any more deaths to come of the incident. She expressed hope that Governor Tom Corbett, the Board of Pardons, and District Attorney Williams will reduce his sentence to life without parole.

Courts have agreed that Williams’ lawyer failed to give him a fair trial, but they also have stated that evidence of sexual abuse would not have made a difference in the sentencing.

Jurors, however, have signed sworn affidavits saying they would not have voted for death if they had known about his past.

Several jurors have also said that they voted for him to be executed because they believed that, if they had not, Williams would be eligible for release on parole.

However, a life sentence in Pennsylvania means the convicted will never be eligible for parole. Pennsylvania is the only state in the U.S. that does not require judges to explain to the jury that a life sentence means there is no possibility of parole.

No explanation of life sentencing was given at Williams’ trial.

Terry Williams’ death warrant for October 3 was signed by Gov. Corbett last week. Corbett is a Catholic Republican.

CALIFORNIA – Cost of death penalty can be calculated

In his opinion piece (“Would repealing the death penalty really save money?,” June 10), Michael O’Reilley tells California voters that passing the SAFE (Savings Accountability Full Enforcement) California initiative on Nov. 6 would not result in any cost savings for the state.

Mr. O’Reilley relies on the same argument advanced by many proponents of the death penalty, which is that there is no reliable evidence that repealing the death penalty will save money because the “true cost” of the current system is “difficult to determine.”

For too many years, Californians have been kept in the dark about how much the state is spending on its broken death penalty system because, they were told, such a cost analysis was impossible to perform. That is simply not the case.

In our three-year-long, exhaustive investigation into the costs of California’s death penalty, Senior Judge Arthur L. Alarcón and I reviewed every available source of cost data. Our mission was to tell voters the truth about what they are spending on the state’s current system — one that has been described as “dysfunctional” by both the former and current chief justices of the California Supreme Court.

Our research revealed that while there is, indeed, a lack of political will when it comes to tracking these costs, there is no question that California’s death penalty has cost taxpayers billions of dollars over the past 34 years. We relied on court records, state budgets, and other objectively reliable data to calculate the costs associated with each stage of process from trials through final appeals.

The findings in our report are supported by the Blue-Ribbon Panel convened by the state Senate, the California Commission for the Fair Administration of Justice, which did a similar study and reported similar data in its Final Report published in 2008.

The following facts are undisputed:

• California taxpayers have funded roughly 2,000 death penalty trials over the past three decades;

• California houses more than 22 percent of the nation’s death row inmates, but has carried out no more than 1 percent of all executions nationwide in that time — 13 executions since 1978;

• The vast majority of condemned inmates die on death row before their sentences are ever carried out, which means that those inmates receive state-funded medical care for the entirety of their lives — an expense that Mr. O’Reilley argues (incorrectly) is incurred only under a life without possibility of parole (LWOP) sentence, but not under a sentence of death.

Voters must decide for themselves whether Mr. O’Reilley’s argument that the current system is a deterrent to violent crime that comes at no added cost to taxpayers rings true. Voters must also consider whether — when it comes to public safety — the current dysfunctional death penalty system is a good use of our state’s limited resources when more than 10,000 homicides committed over the past 10 years remain unsolved.

In the current economic climate, voters should not be satisfied with being told that it is impossible to calculate what the death penalty costs. Voters should demand to know the truth.

Tennesse – Memphis man released after 27 years in prison

A former death row inmate who won a new trial in the 1983 murder of a Memphis grocer has pleaded guilty to second-degree murder and was sentenced to time he already has served.

Erskine Leroy Johnson, 54, was released Friday morning after serving 26 years, 11 months and five days for the shooting death of Joe Belenchia during a holdup on Oct. 2, 1983, at the Food Rite Grocery at 2803 Lamar.

“He is overjoyed at being out,” said Gerald Skahan, chief capital-case attorney in the Public Defenders Office. “He is looking forward to enjoying the rest of his life and spending it helping others.”

He said Johnson has always maintained his innocence, but entered an Alford plea, also called a best-interests plea, so he could get out of prison and avoid putting his family through a trial.

He was released Friday morning from the Shelby County Jail after entering his plea this week in Criminal Court.

Johnson was on death row from Jan. 26, 1995, to Nov. 15, 2004, but was re-sentenced to life in prison after the state Supreme Court ruled prosecutors did not give the defense a police report showing the defendant could not have fired a shot that wounded a customer in the store.

Then last December the Tennessee Court of Criminal Appeals awarded Johnson a new trial, ruling that newly discovered evidence raised by the defense may have caused the jury to reach a different verdict.

The court found that new evidence indicating close relationships among several of the state’s witnesses, if true, could have been viewed as a motive to protect other possible suspects and could have weakened the witnesses’ credibility before the jury.

Johnson said that around the time of the murder he was in St. Louis at a birthday party for his mother.

Prosecutors said Johnson’s palm print was found on the getaway car and that one witness told the jury that Johnson had confessed to “a cold-blooded” shooting in Memphis.

Deputy Dist. Atty. John Campbell said the state offered the settlement because the case was nearly 30 years old and Johnson already had served nearly 27 years in prison. A life sentence under laws in effect at the time of the murder was at least 25 years.

Campbell said prison officials had called Johnson “an exemplary prisoner” and that the state parole board had granted his release scheduled for June 11.

 

ALABAMA MAN FREED FROM DEATH ROW AFTER PROVING PROSECUTOR ILLEGALLY BARRED AFRICAN AMERICANS FROM JURY SERVICE

On May 18, 2012, Victor Stephens was taken off death row after 25 years and resentenced to life in prison. The result came after the United States District Court for the Southern District of Alabama on October 6, 2011, found that the Hale County prosecutor who tried the case illegally discriminated against African Americans during jury selection.

Victor Stephens is African American. During his capital trial, the prosecution illegally used 21 of its 23 peremptory strikes to remove eligible African Americans from serving on his jury. The defense objected, arguing that the prosecutor’s strikes and the prosecutor’s notes made during trial revealed racially biased jury selection in violation of the Equal Protection Clause.

The law requires prosecutors to give reasons for strikes if the judge suspects there is racial discrimination during jury selection. In his notes, the prosecutor wrote “need reason to strike” next to two black jurors but no white jurors, for whom the prosecutor instead wrote actual reasons, such as “hard of hearing.”

The defense argued that the fact that the State “need[ed a] reason to strike” two black jurors, while it did not “need [a] reason to strike” any white jurors, is direct evidence that the State first decided to strike these black jurors and then searched for a pretextual and facially race-neutral reason to give the court.

These notations, together with other evidence in the record, comprise overwhelming evidence proving the State illegally discriminated against African Americans in jury selection, the defense contended.

The federal court agreed, pointing out that the State’s purported reasons for excluding African Americans were not supported by the record and, in some cases, were contradicted by the jurors’ responses during jury selection.

The court further found the fact that the State had a chance to ask jurors about any discrepancies but did not suggests the prosecutor’s explanation was a sham and a pretext for discrimination. “[Unless he had an ulterior reason for keeping [a potential juror] off the jury,” the federal court reasoned, “this court would expect that the prosecutor would have cleared up any misunderstanding by asking further questions.”

In contrast, the prosecutor did ask white potential jurors follow-up questions and did not strike white potential jurors who shared the same “reasons” as black jurors who were struck.

Concluding that the prosecutor illegally excluded black potential jurors based on their race, the federal court vacated Mr. Stephens’s conviction and sentence, granting him a new trial. The State settled the case without a new trial and, on May 18, Mr. Stephens was re-sentenced to life imprisonment without parole.

A recent report by EJI found that racially biased use of peremptory strikes and illegal racial discrimination in jury selection remains widespread, particularly in serious criminal cases and capital cases. Hundreds of people of color called for jury service have been illegally excluded from juries after prosecutors asserted pretextual reasons to justify their removal.

ALABAMA – Expense and execution – Death-penalty cost issue resurges as state struggles

As many states look for ways to reduce spending, a battle is brewing between supporters and opponents of the death penalty.

Opponents contend states could save millions of dollars by abolishing the death penalty. Proponents argue the death penalty is needed to punish defendants convicted of heinous homicides, even when it means decades of paying attorneys to argue the merits of a death sentence and for housing an inmate, such as former Sheffield resident Tommy Arthur.

Assistant Attorney General Clay Crenshaw, chief of Alabama’s death penalty litigators, said he is unsure how much the state has spent attempting to carry out Arthur’s execution, which was first ordered in 1983.

“It’s been so long, I’m not sure if anyone knows how much the state has spent keeping Tommy Arthur on death row all these years,” Crenshaw said.

Arthur, 70, has been on death row for 29 years for the 1982 murder-for-hire killing of Muscle Shoals resident Troy Wicker. His conviction was overturned twice on technicalities. The state Supreme Court has set an execution date for Arthur five times only to have it halted when defense attorneys raised legal issues, most recently in March when they objected to Alabama’s use of the drug pentobarbital in executions.

Arthur continues to maintain his innocence.

Alabama Department of Corrections spokesman Brian Corbett said the agency does not keep tabs on the amount of money spent on legal fees for death row inmates, only the cost of housing them, which is now about $43 per day. He said the department does not separate the cost of housing inmates on death row from the expense of keeping them in other areas of a prison.

Alabama has 101 men and four women on death row. The average age of the death row inmates is 41 and they have been there an average of 11 years and 7 months, Corbett said.

Richard Deiter, executive director of the Washington, D.C.-based Death Penalty Information Center, said states typically do not keep track of the amount of money spent on a single inmate from the time they are sentenced to death until an execution takes place.

“There’s probably not anyone in Alabama who knows exactly how much money has been spent keeping Mr. Arthur on death row, but there is no doubt it has been very expensive,” Deiter said. “All states need to take a serious look at how much they are spending on death penalty cases and decide if it is money well spent.”

Crime victims groups and death penalty proponents contend the cost of capital punishment is offset by the value it provides in deterring homicides and punishing criminals convicted of the most heinous murders.

Deiter contends the money spent on executions should be used to prevent crime.

“The death penalty is not a deterrent to crime,” Deiter said. “Some of the states with the highest number of executions also have the highest homicide rates. Studies have shown it can cost more than $30 million to carry out an execution. Only one in 10 death penalty cases results in an execution and when you combine the legal fees for the appeals of all of those defendants, it makes that one execution very costly. That money could be better spent on hiring more police officers, installing better lighting in high-crime areas, providing education aimed at preventing crime and doing other things to make sure crimes do not happen.”

Miriam Shehane, executive director of Montgomery-based Victims of Crime and Leniency, disagrees.

“I don’t care how much it costs to execute someone, we need the death penalty,” she said. “The death penalty opponents want to argue that it is cruel and unusual punishment. My daughter was abducted, then raped for hours and shot repeatedly. Was that not cruel and unusual punishment? The punishment needs to fit the crimes and for some murders, the death penalty is the only appropriate punishment.”

Shehane’s daughter Quenette was kidnapped and killed in Birmingham in 1976.

Three men were convicted of her murder. One was executed, another was sentenced to life in prison without parole and the other sentenced to life with the possibility of parole.

Lauderdale Circuit Court Judge Mike Jones said he never considers the potential cost of incarceration and future legal expenses when deciding if a defendant convicted of capital murder should be sentenced to death. He said that decision is based on the jury’s recommendation and the circumstances of the homicide.

Economics

When a defendant is convicted of capital murder in Alabama, the jury then hears additional evidence before recommending the death penalty or life in prison without parole as punishment. The judge is not obligated to follow the recommendation when imposing the punishment.

“We don’t need to put someone to death because it’s cheaper than keeping them in prison for the rest of their life,” she said. “At the same time, we shouldn’t not put someone to death because it might be more expensive than keeping them in prison. You don’t make a life or death decision based on economics.”

Jones has imposed the death penalty twice.

He sentenced David Dewayne Riley Jr. to death in 2007 for the 2005 shooting death of Florence package store clerk Scott Michael Kirtley. He sentenced Riley, 27, to death again in 2011 after the Alabama Court of Criminal Appeals overturned his first conviction on a technicality. The jury at both trials recommended that Riley receive the death sentence for the execution-style shooting.

Jones said the possible cost of sending Riley to death row never crossed his mind before carrying out the recommendation of the juries.

“The Alabama Legislature may someday decide we can no longer afford to send people to death row,” Jones said. “That’s a decision they would have to make and until they do, I am going to continue to carry out the recommendations of juries who say someone deserves the death penalty when the circumstances of a murder warrant sending a defendant to death row.”

Political battle

Shehane said the Legislature will face a tough battle from her organization and other capital punishment proponents if it ever attempts to abolish the death penalty in Alabama as a way to save money.

Deiter said with the cost of defending death sentences in the appeals process and even the expense of purchasing the drugs used in executions increasing, some states might have to replace capital punishment with a mandatory sentence of life in prison without the hope of parole as a way to punish defendants convicted of the most brutal homicides.

“All states with the death penalty (will have) to decide if it is worth the expense when they are having to cut back in so many other areas, including courts and police,” Deiter said.

For Alabama, Shehane said, the money spent sending defendants convicted of capital murder to death row and carrying out their execution is worth the expense.

FLORIDA – Declared competent, convicted murderer receives new sentence

Carlos Bello was originally sentenced to death after being convicted of first-degree murder in the death of Detective Gerald Rauft in 1981. A change in his sentencing means he will spend life in prison.

The man convicted of killing a Tampa police detective more than 30 years ago will spend the rest of his life behind bars.

According to Bay News 9’s partner newspaper the Tampa Bay Times, Carlos Bello claimed for decades he was too mentally ill to understand his conviction.

Bello was sentenced to death after being convicted of first-degree murder in the death of Detective Gerald Rauft in 1981. That sentence was later thrown out. Since then, Bello’s attorney said his client was too incompetent to understand court proceedings or his sentencing. But, last February a Hillsborough Circuit Judge declared Bello competent.

Within the past month Bello has shown an understanding of life in prison over a death sentence.

In court Wednesday he said understood perfectly that the court was offering life behind bars instead of the death penalty.

The Georgia pardons board made the rare decision on Friday to spare the life of a condemned man who was set to die this week for the 1991 murder of his ex-classmate.

The move by the Georgia Board of Pardons and Paroles to reduce Daniel Greene’s death sentence to life in prison without parole came days after the board stayed his execution. Greene was initially set to die on Thursday for the murder of 20-year-old Bernard Walker, who was fatally stabbed as he tried to help a store clerk attacked by Greene.

It was only the fourth time the board has commuted a death sentence since 2002, and it came after an outpouring of support for the Taylor County man by community members, a change of heart by the prosecutor who tried the case against him and a powerful plea for mercy from the condemned man himself.

“I think Daniel’s remorse is very apparent. He’s led an exemplary life before and since these incidents,” said his defense attorney, Jeff Ertel. “It was an aberrant act surrounded by 20 years on each side of an outstanding life.”

Greene, 42, has been on death row for almost 20 years. His crime spree began on Sept. 27, 1991, when he robbed clerk Virginia Wise at her Taylor County convenience store and then stabbed her through the lung. She survived the attack.

Moments later, Walker entered the store and tried to help Wise. Greene stabbed his former classmate through the heart before fleeing, leaving Walker to die in the store’s parking lot. Greene then went on to attack an elderly couple in nearby Macon County and another store clerk in Warner Robins before he was arrested.

A standout defensive lineman in high school, Greene had to be tried in Clayton County because of all the media coverage in his hometown. He was convicted in December 1992 of murder, robbery and assault and was sentenced to death.

At a closed-door meeting on Tuesday, nine of Greene’s supporters spoke on his behalf, and many more sent in impassioned letters urging the board to spare his life. They described him as a gentle giant and hardworking student who stayed out of trouble until the “drug-crazed transgression.”

Former Taylor County Sheriff Nick Giles called him a “beloved son” of the community, and a former corrections officer who knew Greene in prison said he was “as fine a man as I have ever met in my life.”

Greene also sent in a letter to the board expressing his remorse for the pain and suffering he caused Walker’s family.

“I was on drugs at the time, but I took the drugs with my hands, and I take the responsibility. That choice to do drugs and what I did after were the worst mistakes of my life,” he said in the letter. “I do not blame the drugs. I blame myself for everything.”

Taylor County Sheriff Jeff Watson, who went to school with Greene and Walker, said the community was split over the pending execution. He and a local pastor visited Greene in the days leading up to it, and said they found Greene to be remorseful.

“I know a bunch of people went to bat for him, and others think he should be executed. I’ve heard both ways,” he said. “And I know there were a lot of people who are pulling for him.”

District Attorney Julia Slater didn’t immediately return calls seeking comment. Walker’s sister, Amanda Walker Prude, declined to comment.

Mark Shelnutt, the Columbus attorney who prosecuted Greene, told the paroles board that what led him to seek capital punishment was that life without parole was not a sentencing option for Georgia juries at the time.

The death penalty, he said, “was the only way you could make sure he wouldn’t hurt someone again.” But when he went before the board this week, he said he told the five-member panel he was having second thoughts about the death sentence.

“Things back then were so black and white, so right and wrong. I think what happened is I’m not the same person that I was then. I’ve had more experience, and I’ve seen the justice system involved, and the imperfections of it,” he said. “Much more heinous crimes have resulted in life sentences, and that’s what I told them.”

NORTH CAROLINA – Judge Blocks Death Sentence Under Law on Race Disparity

Concluding that racial bias played a significant factor in the sentencing of a man to death here 18 years ago, a judge on Friday ordered that the convict’s sentence be reduced to life in prison without parole, the first such decision under North Carolina’s controversial Racial Justice Act.

Reading a summary of his ruling from the bench, Judge Gregory A. Weeks of Cumberland County Superior Court said that “race was a materially, practically and statistically significant factor in the decision to exercise peremptory challenges during jury selection by prosecutors” when the inmate, Marcus Reymond Robinson, was being tried.

The disparity was strong enough, the judge said, “as to support an inference of intentional discrimination.”

From the jury box where they sat, the relatives of the man Mr. Robinson killed, Erik Tornblom, watched in disappointed silence. Mr. Robinson, wearing all white, was seated with his lawyers, his head lowered as the judge read his ruling.

The state said it would appeal.

The landmark ruling is expected to be the first of many under the law, which allows defendants and death row inmates to present evidence, including statistical patterns, that race played a major role in their being sentenced to death.

Over the course of the hearing, lawyers for Mr. Robinson presented the findings of a study by Michigan State University researchers showing that prosecutors used peremptory challenges to remove blacks from juries more than twice as often as they used such challenges against whites. The study, which Judge Weeks called valid and reliable, found that disparity existed statewide, and to an even greater degree here in Cumberland County and in Mr. Robinson’s trial in particular.

Prosecutors, who have fiercely opposed the law since it was passed in 2009, criticized the Michigan State researchers’ methodology, but, more pointedly, they said that jury selection was a “complex discretionary system,” with thousands of possible reasons to remove a potential juror. To assume that race was the motive behind many of these decisions, prosecutors said, was not only wrong, but offensive.

“They do not have evidence of purposeful discrimination,” Rob Thompson, an assistant district attorney in Cumberland County, said in his closing arguments. “They do not have some secret society of prosecutors maniacally plotting to remove people from juries. They do not have any of that because there is no such evidence. It doesn’t exist. They have numbers.”

A Statistical Analysis of Survey Data from Clark County Defense Attorneys

I. Introduction
A survey was designed to provide average estimates of the time spent at various stages of criminal processing for the defense of capital and non-capital murder cases. Defense attorneys were asked to use their personal experiences over the past three years to estimate the number of hours they spent in pretrial, trial, penalty, and post-conviction activities in a “typical” capital and non-capital murder case. Separate questions were asked about their experiences as “lead attorney” and “second chair” in these typical cases. A total of 22 defense attorneys completed the survey. The largest group of survey respondents were attorneys within the Public Defender’s office (n=10), followed by the Special Public Defender’s office (n=9) and the Office of Assigned Counsel (n=3). To provide some context for the time estimates provided by these defense attorneys, this survey data was also supplemented with general case processing information on a sample of 138 murder cases sentenced in District Court between 2009 and 2011. The Clark County Court’s electronic record system was used to identify these murder cases and to construct summary statistics on case processing (e.g., average time between court filing and sentencing; number of total meetings with parties present, number of orders and motions filed). These court statistics were analyzed separately for each major type of sentence (i.e., yearly maximum sentences, life with possibility of parole, life without possibility of parole, and death sentences). For the survey data included in this report, the median score (i.e., the middle score of a distribution) is used as the average estimate of time spent at each stage of criminal processing. The median is the most appropriate measure for these analyses because (1) it minimizes the impact of extreme ratings and (2) the distribution of time estimates across respondents is not normally distributed. Under these conditions, the median, rather than the mean, is the appropriate summary measure of central tendency.
